Field of application

These terms and conditions apply to all deliveries and services by americanfood4u in compliance with orders, which the customer did not place in connection with his commercial or self-employed business. We do not accept conflicting terms and conditions or a customer's differing terms and conditions, even if we deliver without reservation although we are aware of conflicting or differing terms and conditions by the customer.

Right of withdrawal

The customer has the right to withdraw his/her contractual statement within 2 weeks in written form (e.g. letter, Fax, E-Mail) or by returning merchandise without giving reasons.

The cancellation period begins, as soon as the customer receives these rights of withdrawal, the articles of agreement including our terms and conditions as well as the information, which are included in the ordinance after

In case of exersion of the right of withdrawal, services on both sides have to be returned. In case of exersion of the rigth of withdrawal, the customer is obliged to return, if the merchandise can be shipped in a package. In case the merchandise cannot be shipped in a package, we will pick it up. We bear the cost and danger in case of return and withdrawal. However, the customer has to bear the cost of return if the prize of the returned merchandise does not exceed the amount of 40,00 EUR or if, in case the prize of the merchandise is higher, the customer did not yet pay the merchandise at the time of the withdrawal, except the delivered merchandise does not comply with the ordered merchandise. In case the customer cannot or cannot patially or only in a declined condition return, he/she has to pay compensation for the value of the merchandise. This does not apply, if the decline of the merchandise can be traced back exclusively to the control of the customer - similar to the possibility of control/check of merchandise in a retail store. By the way, the customer can avoid paying for compensation by not using the merchandise like his personal possession and by avoiding any action that might affect the value of the merchandise.

Guarantee

Guarantee will be issued according to legal requirements, whereupon, in case of insufficiency of merchandise, we deliver in addition or repair after your choice. Should the merchandise which was delivered in addition also be bad or we are unable to repair the merchandise, you can return the merchandise upon complete refund or keep the merchandise and lower the prize. You can get information about a possible manufacturer guarantee in our product documentation.

While buying you agree, that you gather information about our groceries from our product sites. For this reason, you accept the online labeling as food labeling. Products with German labels are available on demand. Please add this demand to the commentary field while ordering.

Place of Jurisdiction

The place of jurisdiction for contracts with traders, legal people of the public law or public separate assets for all litigations resulting from the business connection, including actions on a bill, is exclusively declared to be the domicile of the seller.
